In November 2022, Arcata residents voted to pass Measure M.
At its meeting on December 15, 2022, the Arcata City Council discussed whether to uphold the voter-passed measure due to uncertainty about its legality. Ultimately, the council unanimously voted to uphold Measure M and concurrently seek judicial resolution to determine if the Measure violated State or Federal Law. In April 2024. the Court ruled that flying the Earth flag above the American flag was unlawful. The group, "Citizens in Support of Measure M," appealed the decision and in late June 2025 the appellate court informed the City of Arcata of its decision to uphold the lower court's ruling.
In compliance with the court's ruling, the City of Arcata will fly the American Flag at the top of municipal flag poles, otherwise known as first position, henceforth.
